INTRODUCTION

This agreement contains the complete Terms and Conditions that apply to you after registration and/or making a purchase on Monchou. By using or shopping at e-store, you agree to be bound by its terms of use and shall comply thereof. This agreement describes and encompasses the entire arrangement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to Monchou, the content and computer programs provided by or through the e-store, and the subject matter of this agreement. Amendments to this arrangement can be made and effected by us from time to time without specific notice to your end. Terms and Conditions posted on Monchou reflects the latest agreement, it is obligatory to get acquainted with it before making a purchase on our e-store.

PAYMENTS

Monchou has the sole discretion to provide the terms of payment. Unless other term has been agreed upon, payment for the products shall be made by Visa, Mastercard, Amex. If the preferred method of payment is by invoice, invoices are due and payable within the time period agreed. Monchou has all the discretion to cancel or deny orders. Monchou is not responsible for pricing, typographical or other errors and we reserve the right to cancel any orders arising from such errors.

RISK OF LOSS

All items purchased from Monchou are insured in accordance with the shipping contract. The parcel is declared to be lost if the delay in delivery reaches up to three months. In the case of a lost parcel our contractor will be notified and after a series of investigations, if the parcel is still missing, you will be compensated for the full amount of your order. Customers will always have an option to request a replacement, depending on the availability. The issues concerning the parcel is the responsibility of the third party.

INTERNATIONAL SHIPPING

Packages internationally are shipped by our partner delivery company Aramex. Usually delivery takes 7 working days, but due to Covid19, the shipping might take a little longer, then expected.

LOCAL SHIPPING

Packages in Georgia are shipped by Georgian post. Usually delivery takes 3-5 working days, but due to Covid19 , the shipping might take a little longer, then expected.

DUTIES AND TAXES

Any Purchase delivered outside of Georgia may be subject to duties and taxes. The law regarding the import duties differ from county to country. Taxes and duties are calculated according to your shipping destination and are not included in the final price.

PRICING AND DESCRIPTION

Prices displayed for products on Monchou represents the full retail price listed on the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere. We do not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered in our website is not as described, your sole remedy is to return it in unused condition.

ACKNOWLEDGMENT OF RIGHTS

You hereby acknowledge that all rights, titles and interests, including but not limited to rights are covered by the Intellectual Property Rights. You will not acquire any right, title, or interest in or to the program expressly set in this agreement. You hereby agree that you will not modify, adapt, translate, prepare derivative works, decompile, reverse engineer, disassemble or attempt to derive source code from any of our services, software, documentation, as well as create or attempt to create a substitute or similar service or product through use of or access to the program or proprietary information related thereto.

FRAUD

Fraudulent Activities are highly monitored in our site and if fraud is detected Monchou shall resort all remedies available to us, and you shall be responsible for all costs and legal fees arising from these fraudulent activities.

NON-WAIVER

Failure of Monchou

to comply upon strict performance of any of the terms, conditions and agreements hereof shall not be deemed as a loss or waiver of any rights or remedy that we may have, nor shall it be interpreted as a waiver of any subsequent breach of terms, conditions or agreements. Hereof terms, conditions and agreements shall continue to be in full force and effect.

No waiver by either party of any breach of any provision hereof shall be deemed a waiver of any subsequent or prior breach of the same or any other provision.

MISCELLANEOUS

This agreement shall be governed by and construed in accordance with the substantive laws of Georgia, without any reference to conflict-of-laws principles.

Any dispute, controversy or difference which may arise between the parties out of, in relation to or in connection with this agreement is hereby irrevocably submitted to the exclusive jurisdiction of the courts of Georgia, to the exclusion of any other courts without giving effect to its conflict of laws provisions or your actual state or country of residence.

The entire agreement between the parties with respect to the subject matter hereof is embodied on this agreement and no other agreement relative hereto shall bind either party herein.

Your rights of whatever nature cannot be assigned nor transferred to anybody, and any such attempt may result in termination of this agreement, without liability to us. However, we may assign this agreement to any person at any time without notice.

In the event that any provision of these Terms and Conditions is found invalid or unenforceable pursuant to any judicial decree or decision, such provision shall be deemed to apply only to the maximum extent permitted by law, and the remainder of these Terms and Conditions shall remain valid and enforceable according to its terms.

RETURNS AND EXCHANGES

RETURN/EXCHANGE PROCEDURES FOR INTERNATIONAL CUSTOMERS

The main aim of the Monchou is to provide excellent service and high quality products as offline and online to its customers. We do our best to provide you with the best customer experience and satisfaction with your purchases. Shall it happen that you are not fully satisfied with your purchase, you may return the item(s). Monchou is open to accept the returns within 7 days after receiving the parcel. The item(s) must be in unused, unworn, unwashed and undamaged condition. Item(s) must be returned in the original packaging (including tags, boxes and pouches). Please, avoid wearing make-up foundation, perfume or deodorant when trying on clothes as we will not be able to accept the return with the evidence of marks or scent on the item(s). In case your parcel is damaged, on arrival you must declare such damage before the courier. Once returning the parcel item must be declared as a returned item, do not to declare the cost. In case you decide to return an item, please, follow the relevant procedures.

After sending us an e-mail Monchou team will receive your request and you will be informed about the next steps. Monchou customer is not allowed to return the parcel without following the procedure mentioned above. Note that you are responsible for shipping and handling expenses and they are non-refundable.

REFUNDS

Once the returned parcel reaches the warehouse of Monchou, you will receive confirmation e-mail and money will be refunded to you (excluding shipping cost) wthin ten working days after receipt of the parcel, except holiday season, during which return processing may take more time than expected.

PLEASE NOTE: No refunds will be issued for an item returned in a used/damaged condition or without the original tags, pouches and boxes. The parcel is your responsibility until it reaches Monchou. We recommend sending the parcel using a delivery service that insures you for the value of the products. “Sale”/” Special Offer” items are non-returnable or refundable. You may only exchange the sale items.

EXCHANGES

All return conditions apply to exchanges as well. You can exchange the purchased item for a different size or colour. Choose the “exchange” option during the Return/Exchange procedure in your account and write down a desired size/colour/style. All exchanges are based on stock availability. When we receive your return, we will send the replacement to you. Please note, you can exchange only once per item. Note that you are responsible for shipping and handling expenses.
